Terms of Service

Accounts and access

Accounts on Vymjay are created top-down: a platform operator onboards a buying office and its administrator, and that administrator creates accounts for the office's members. There is no public self-signup.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

Acceptable use

You agree to use Vymjay only for lawful business purposes related to garment sourcing and buying-house operations.

You may not attempt to access another organization's data, disrupt the service, reverse-engineer the platform, or use it to store unlawful content.

Your data

You retain ownership of the business data you submit to the platform. You grant us the limited rights needed to host and process that data in order to provide the service.

Service availability

We aim to keep the platform available and reliable, but the service is provided on an “as is” and “as available” basis. We may modify, suspend, or discontinue features from time to time.

Samples and quality arbitration

For orders that proceed through sampling, the physically approved TOP (Top of Production) sample is the binding arbiter of quality. It is the reference standard against which bulk production is judged.

The Buying Office quality-control report, which compares the bulk goods against the physical TOP sample, overrides subjective, after-the-fact quality disputes between a buyer and a manufacturer. Bulk production is unlocked only once the pre-production (PP) sample has been approved.

Payments and integrations

Certain capabilities — such as online payments and logistics — may be introduced over time and may be subject to additional terms and third-party provider terms at that time.

Limitation of liability

To the maximum extent permitted by law, Vymjay shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.

Governing law

These Terms are governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the courts of Tamil Nadu, India.

Changes to these Terms

We may update these Terms from time to time. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
